Kate Spade Saturday wins trademark dispute

Fifth & Pacific-owned brand Kate Spade has won a trademark dispute

relating to its Kate Spade Saturday brand name and logo against apparel and accessories retailer Saturdays Surf NYC.

According to legal documents, Saturdays Surf NYC stated that the due to Kate Spade’s high profile name that consumers would believe that its brand was licensed by Kate Spade, however this week the court ruled that “both companies and brands can peacefully co-exist in the market”.

Filed in the United States District Court for the Southern District of New York, the judge added that it was unlikely that consumers would believe that Kate Spade Saturday, which it is aimed at women, would license to a men’s clothing company.

Kate Spade Saturday is the labels new global lifestyle brand which has been created to “channel the spirit of Saturday seven days a week”. Aimed a younger, more accessible customer than Kate Spade, the line includes apparel, handbags, accessories and items for the home.
